Allege serious legal and ethical breaches of conduct while serving on the Middletown Board of Education
Scharfenberger: "Walsh needs to take a serious look in the mirror, at her actions and votes while on the school board, and reconsider her run for township committee."

Middletown Republicans have taken issue with the financial dealings of Democratic committee candidate Patricia Walsh.
Court documents produced by GOP officials detailed Walsh's failure to disclose over $30,000 in gifts on both her annual tax return and her personal financial statement in 1998 and 1999, filed in April 1999 and March 2000, respectively.
"I find it uncanny that someone who lectures others on governance and ethics doesn't appear to have her own house in order, not to mention that her record on the school board has been a disaster." said Mayor Gerard Scharfenberger. "I think Walsh needs to take a serious look in the mirror, at her actions and votes while on the school board, and reconsider her run for township committee."
According to a February 2000 letter sent to the Lakewood law firm of Bathgate, Wegener & Wolf, Walsh was the recipient of a check for $20,000, dated Nov 2, 1998.
The letter, from the Red Bank law firm of McKenna, DuPont, Higgins & Byrnes, described the two checks from John L. and Cathy Sullivan, Leonardo.
GOP officials also provided a copy of a check for $10,000. It was dated Feb 2 1999, signed by Cathy Sullivan and endorsed by Walsh. The copy of the check had the word "legal" scrawled on the bottom left.
"Walsh wanted the school board to pay her legal bills," Scharfenberger said Friday, Oct. 3. "The school district would not, which is why Walsh took the gifts."
"No disclosures were made, as required by the School Ethics Act," Scharfenberger said. "Walsh never had any written loan agreement, there was no term of repayment, there was no interest charged, there was no security, and no indication that Cathy Sullivan has ever been paid back for her gift to Walsh."
Numerous attempts to reach Walsh before the daily deadline were unsuccessful. Attempts to obtain responses through phone and email went unanswered.
Calls to Cathy Sullivan were not answered.
Deposition…
Walsh's statements during a January 2000 deposition substantiated many areas of the issue.
"[Walsh] was subpoenaed to provide testimony in a civil action filed on behalf of Thomas Stokes, who initiated the litigation after the dismissal of Walsh's municipal action against him," the mayor said.
Walsh filed sexual harassment charges against Stokes during their time serving together on the BOE, after a verbal exchange at a board meeting. The dismissal of Walsh's municipal action prompted Stokes to file a civil action, resulting in her subsequent involuntary deposition.
During questioning, Walsh admitted under oath to both taking out a loan and discussing her mounting legal bills with Cathy Sullivan. The longtime BOE member denied introducing the topic to Cathy Sullivan, who would ultimately give Walsh over $30,000.
According to the court records, Cathy Sullivan already knew about Walsh's need for money. Walsh never specified how much the size of the loan had been. She also denied having any record of evidencing the sizable amount of cash, possessing no documents that could verify that the money was, in fact, used for legal bills, as was asserted.
While giving testimony, the committee candidate failed to recall whether she deposited the checks into her personal bank account
"The only money I received relating to coverage of my legal fees involved in the civil action with Mr. Stokes is two checks from Miss Sullivan and the money collected by Mrs. Fenton," Walsh said in the judicial transcript. Mrs. Fenton is deceased former BOE member Karen Fenton.
When asked whether money collected by Fenton was raised at a "pool party" located at the residence of the Sullivan family, Walsh could not recall the specifics. "I don't know how Mrs. Fenton collected the money, so I cannot answer that."
According to the records, Walsh said she accompanied Fenton to the bank, where her name was added to an existing account containing between $500 and $700.
With respect to undisclosed funds gathered by Fenton, officials asserted Walsh directly wrote checks out to herself from the account.
Under questioning, she admitted to withdrawing funds from the account, but could not recall how the money was spent. Walsh could not recall whether the money from that account went toward legal bills or not.
The money given to Walsh by Fenton and Sullivan was never reported to the proper channels, the former BOE president conceded during testimony.
"I did not know it has to be reported on [a BOE financial disclosure form]," she said to the attorney questioning her.
Walsh testified that the gifts were not reported on state or federal income tax returns either.
Misdeed or misunderstanding?
On October 15, 1999, Cathy Sullivan sued the school board for violations of Open Public Meetings Act, according to official documents; apparently claiming proper notice was not provided for a meeting.
"Walsh therefore took money from someone who was soon thereafter adverse to the school district in litigation," said Scharfenberger.
Scharfenberger said Cathy Sullivan's husband was a former school board president, while Fenton was another friend of Walsh's who was formerly on the board and frequently appeared with Cathy Sullivan on various matters before the school board.
The mayor said Walsh championed whatever Fenton and Sullivan wanted during BOE meetings without ever disclosing they were paying her.
More conflicts of interest and waste of taxpayers dollars
Scharfenberger said that Walsh has a history of conflicts of interest and a disregard for taxpayers.
"Notably, her frivolous complaint against Mr. Stokes also resulted in the school board having to pay his legal bills," he said. "On August 27, 1997, Walsh spoke against paying Stoke's legal bills even though she had a direct personal involvement in the matter, which is an obvious conflict in violation of the School Ethics Act."
Even after receiving advice on September 23, 1997, of the improper nature of her involvement, Scharfenberger said Walsh still voted against the payment of Stoke's legal bills.

Campaign season has begun. Let's all stop being naive. With the Democratic weekly coming out with two blatant issues aimed at exposing weaknesses in their opponents.
For starters in all honesty the two pieces against the Republicans were almost laughable in nature and scope. They were stretching way too far. The contamination will make your paper look silly again.
That established, the Republican blog has turned daily campaign center. This was obviously an assignment given out by GOP heads. I mean, I credit the writer for admitting the documents came from Republicans in Middletown. That is a level of honesty rarely attained at the courier. Scharfenberger was stretching in the GOP counterattack, but in my opinion was a good first attack.
Those unfamiliar with Pat's past will be startled by the shaky story and the ice cold description.
Round One: Republicans.
Let's see who wins next time they happen to release obviously partisan attacks on the same day.

Partisanship aside, I find this stroy very disappointing an a couple of levels.
I am very disappointed that Pat refused to respond to JJ. We were beyond fair in reaching out to her. We would have given her a fair and unvarnished opportunity to respond.
There are other stories we are working on. I hope she responds when we call her about those. Her responses will be printed.
I've only been activly involved in politics outside of Highlands for the last 2 1/2 years since I started this blog.
In that time, I have had different experiences of Pat Walsh. My first experience of her was when she was a strident spokesperson campaigning against my friend Freeholder Anna Little. Pat became charming and friendly when the Democrats were attempting to recruit Little to switch parties.
Pat was a great fan of this blog and wrote glowingly of what I do here when I was dismantling the Puharic administration and Bill Barham's freeholder career. Now she won't talk to us. Oh well. History shows that is not a smart strategy. Search Fred Neiman, Adam Puharic, Bill Barham and Jim Purcell in the archives. All of those people stopped talking when I started covering them. All have taken a back seat.
I am disappointed that Pat apparently took money and didn't report it. I am disappointed that it appears to have influenced her actions as a public servant.

This story was not "an assignment given out by GOP heads." Three GOP heads have rolled with the help of this blog. Republicans, Dems, and others pitch me stories daily. My bias is for good government and smaller government. I don't make money from politics or government and have yet to try to make money from the blog. Government in Monmouth County became much better with the addition of a very astute democrat,Freeholder Mc Morrow and the same could be the case in Middletown were it not for the republicans always crying in their towels and finally decide to work with the democrats for good government for the people of this township.This is not Trenton...it's Middletown Township and it's residents recognize that.

I agree that Barbara is a good freeholder. In my biased opinion, Anna Little had more to do with improving Monmouth County government than anyone and the impact of her short tenure endures. That is not to take away anything from McMorrow's contributions.
Sean Brynes shows the potential to be a good leader and work across the isle. But Short and Walsh are stictly partisans. They don't compare to McMorrow. Don't insult Barbara that way.
You're right, Middletown isn't Trenton, but it will become a lot more like Bloomfield, Cherry Hill or River Edge if the Dems take control.
Anyone who knows Pat Walsh knows she will do anything to further her political career - lie, cheat, disparage others. Now you can add hypocrite for being everything she falsely accuses others of being. You can't argue with hard evidence - that's the reason she hasn't returned phone calls.
You want the shenanigans of Pat Walsh? How's this? At the last BOE meeting, Laura Agin got up in the middle of the meeting and left to drive her daughter home. A vote was taken and ended in a 4-4 tie. Doesn't pass. Agin comes back, Walsh asks to speak to her behind the bookcase for a minute. They disappear and come back to the dais. Pat Walsh asks for another vote. This time the measure passes 5-4. This is Walsh's idea of transparency in government.

I don't believe you intended to insult Barbara, but in my opinion to compare the Middletown Democratic officials and candidates, with the possible exception of Byrnes, to Barbara is an insult to her.

I don't know Soden or Fiore well enough to judge who is a better candidate. However, I do know that no one has been able to tell me where Democrats are doing a better job governing than Republicans are doing in Middletown and Monmouth County.
I'm all for split government, as I have stated here numerous times. I just can't see giving the Dems control. It is too risky.

We took care of the former chairman. Anna is doing a great job as Mayor of Highlands. We need her there.
I was not happy about what happened with her in Freehold either. I did something about it.
As I said earlier, I get pitched stories frequently. This one is dirty, this one is a despot, etc. My response is always the same: "Get me documentation." That usually stops them.
This is one of the rare pitches where the documentation was provided.
I don't deal in rumour or innuendo when it comes to serious charges. When I report a rumour, you will know it is a rumour up front and it won't be about criminal or ethical violations. When such unsubstainiated rumours are spread by others, I call the mongers out and challenge them to prove it. Even if the mongers are my allies and those being smeared are my adversaries. Go through the archives, you will find where I have done that.
So yes, I need a lot more. I'm not prepared to surrender Middletown or Monmouth County to the Dems because some people's feeling are hurt. The GOP continues to correct itself locally and I am proud to be a part of that.
If you have something real, be prepared to document it.

Scharfenberger is a stand up guy, doubt he would comment on this in such a public manner if there wasn't hard info backing it up. The truth is the truth. I can understand why the dems would be upset, but they should be upset at walsh for hiding this from them every time she has run for higher office year after year. The only one who should be answering questions is walsh: 1) why were you given this money; 2) were the sullivan's straw people for someone else; and 3) did the sullivan's do business with any school district vendors?
You can't argue with the fact that Art usually comes out on top. Purcell moved to Alaska, last time I checked
I thinks this report, if supported by documented fact, merits a serious investigation into the financial life of Walsh. It sounded as if this tiny "crumb" leaked to the blog by the GOP served as a warning of future revelations as the elections draws closer. In my liberal opinion, this is an issue that must be either addressed or pursued.

This is a disgrace if true, and this woman should be held accountable for her actions.
She lost a vote today.
The comments are documented and true. So true that a local citizens group filed a Recall petition with the Board of Education in Middletown very recently. You'll be reading about that very shortly in all of the local media papers.
My question is - what does Walsh have on the other BOE members that they would sit there all this time and not say anything? Maybe they should be investigated too. Perhaps a call to Chris Christie's office is in order.
A few questions linger-
If evidence of this alleged wrong-doing by Walsh surfaced in January 2000, why has it not been investigated and adjudicated yet?
The story states that Walsh was subpoenaed on behalf of a civil suit filed by Thomas Stokes. How was that case resolved?
Scarfenberger states that Walsh championed whatever Fenton and Sullivan wanted during BOE meetings. Does he have any evidence of this? If so, what did Sulllivan and Fenton gain from this relationship?
Scarfenberger brings up that Walsh caused the township to pay Stokes legal bills. How were Stokes' legal bills paid for in the subsequent civil suit he brought against Walsh?

This just adds another layer in the large pile of Pat Walsh hypocrisy. She lectures the town council on spending, yet has been at the forefront of huge spending for the schools the entire time she has been there. Her husband is a teacher and member of the NJEA - Pat Walsh votes on teachers contracts with the NJEA - anyone see a conflict? Any wonder the teachers are given big fat raises every year?

Wayne Bryant, Joe Coniglio and countless other corrupt politicians were never fined by state ethics panels, yet they are now on trial before the U.S. Attorney. So that certainly doesn't get someone off the hook.

It's pretty good. Walsh is using her long tenure on the BOE as a qualification for office. Exposing the lowlights of that tenure is fair game.

Maybe the Middletown GOP has better opposition research than the Handlin campaign had. Maybe Handlin didn't think she needed to use it to defeat Walsh.

This is a legit issue. It goes to Walsh's credibility or lack thereof on many levels.
She's campaigning on her record. This is part of her record.
She's calling for more transparency, yet she fails to disclose her own conflicts.
She and the Dems have been recklessly calling the GOP corrupt for years, yet she acceptted gifts, didn't report them and acted in an official capacity with clear conflicts.

Are you talking about the muncipal complaint or the civil suit?
Either way we'll look into it and report here if it is germaine.
The outcome of the case is really irrelevant to the matters at hand.
This is hypocritical of Walsh on so many levels I am sick. As a person with one child in school, I may start paying mpore attention to the BOE elections

It is widely known that after her failed candidacy last year for Assembly, Walsh was looking to run as a Democrat for Freeholder this year. There is a press release you can Google to verify her throwing her name in the hat. Instead, the Dems chose BOE member Glen Mason of Hazlet. With this said, could the County Dems have done this background and vetted her out? There is so much at stake on that level that they may not have wanted to take a chance. As to how she became a candidate for Assembly, it's called "sacrificial lamb". Caliendo seems to have been asleep at the wheel when he grabbed her after the County Dems tossed her aside. This could be a costly mistake.
Funny how the Democrats round the wagons when one of them gets caught in an illegal/unethical behavior, Rather than being outraged the way anyone would be who wants honesty and integrity in their elected officials, these people come out and say "so what." Same tactic used by Wayne Bryant, Sharpe James, Mims Hackett, Scarpelli and all the rest. Hoepfully the end result will be the same
The word around town is that the Middletown Dems knew about this, but after Short got elected even after falsifying petitions and getting slapped around in county court, they figured that people would have short memories and they could slip another one through with ethics problems. Looks like this one won't be so easy to hide.

I have to say I think Pat is a disgrace. You should have seen her at the 9/24/08 Board of Ed meeting and the re-vote that someone mentioned in an early post. Transparency in government my ass! Members of the public really need to go to the BOE meetings and see what happens at these meetings and how they spend tax payers money. I think alot more people would vote against the budget. I would like to know more about the recall petition filled with the BOE by the local citizens group. Will we hear more about this at the next BOE meeting?

Walsh dodged the question, from what I have heard from my sources. It was not quite what King Caliendo expected!!!
I raised no stir nor created no ruckus during the Democratic press conference. I asked Mrs. Walsh some questions regarding recent reports and I was given her official response (for the time being).
I respect both candidates and look forward to further discourse as the elections draw closer.
(PS Popular the contrary belief, I am, in fact, the MESSENGER, and, therefore protected from reactive fits of rage and/or "shootings." Those should be directed at Art.)
